INTERNATIONAL HUMANITARIAN LAW AND MEDICAL CONFIDENTIALITY

This study focuses on appraising the right of wounded and sick to medical confidentiality within context international armed conflict in International Humanitarian Law. It finds a correlation between general protection accorded IHL. The paper argues that hostilities, just like peacetime, exists protect sick. However, it is major finding this as important may be, because military personnel owe dual loyalty, (one profession other Military), they face dilemma striking balance these responsibilities, which turn affects their obligation respect confidentiality. To address challenge, recommends greater commitment by States obligations under IHL through provision adequate training for civilian what duty entails; stipulation effective sanctions against violation domestic laws.
